These Terms of Service (Terms) govern access to and use of the Command Arena website, accounts, games, subscriptions, communications and related services (collectively, the Service).
The Service is operated by Command Arena Limited, a company incorporated in New Zealand (Command Arena, we, us or our). Questions may be sent to our privacy contact:
.
By creating an account, purchasing Premium, or otherwise using the Service, you agree to these Terms. If you do not agree, do not create an account, purchase Premium or use the Service.
Our Privacy Policy explains how we handle personal information. It is incorporated by reference for information purposes but is not intended to reduce any privacy rights given by law.
You must be at least 13 years old to create or use a Command Arena account. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.
If you are under the age at which you can enter a binding contract where you live, your parent or legal guardian must review and agree to these Terms on your behalf. Additional parental permission may be required where local law applies.
You must provide accurate information, keep your email address current, and protect your password and account sessions. You are responsible for activity carried out through your account unless it results from our security failure or another cause for which the law makes us responsible.
Tell us promptly if you believe your account has been accessed without permission. We may require reasonable verification before changing account details or restoring access.
Subject to these Terms, we give you a personal, limited, revocable, non-exclusive and non-transferable permission to access and play the Service for private entertainment. You do not receive ownership of the software, game systems, artwork, maps, audio, trademarks, databases or other Service content.
You must not misuse the Service or interfere with other players. Prohibited conduct includes:
We may investigate suspected misuse, preserve relevant evidence, remove content, restrict features, reverse illegitimate results, suspend accounts or terminate access. Where reasonably practicable, we will consider the seriousness, evidence and context of the conduct.
You retain any rights you have in content you submit, such as a callsign or chat message. You give us a worldwide, royalty-free, non-exclusive licence to host, copy, display, transmit, moderate and adapt that content only as reasonably needed to operate, secure, promote and improve the Service.
Do not submit content you do not have the right to use. We may remove or restrict content that violates these Terms, law, safety requirements or another person's rights. Public or multiplayer communications should not be treated as private.
Premium features, price, currency and billing interval are shown at checkout. Unless the checkout page says otherwise, Command Arena Premium is intended to cost USD $5.00 per month.
Premium renews automatically at the stated interval until you cancel. Before purchase, we will clearly display the recurring price, billing frequency, cancellation method and any trial or promotional terms. You must provide affirmative consent to the recurring subscription terms.
Payments are processed by Stripe or another payment processor identified at checkout. We do not receive or store your complete payment-card number. Your payment provider may apply its own terms and privacy policy.
You may cancel online through Account Settings. Cancellation prevents the next renewal. Unless required otherwise by law or expressly stated at checkout, Premium remains available until the end of the period already paid for and we do not provide a partial-period refund.
We may change the Premium price or material subscription terms prospectively. We will provide advance notice and cancellation information where required by law. A price change will not be applied earlier than stated in the notice.
Taxes, foreign-exchange charges and payment-provider fees may apply depending on your location and payment method. The checkout page will display amounts we charge; your bank or provider controls its own conversion and fees.
Any trial, discount or promotional offer is subject to the specific terms shown with that offer. If a trial converts to a paid subscription, the conversion price and timing will be disclosed before consent. We will provide reminder notices where required by applicable law.
Except where the law requires otherwise, charges are non-refundable after a billing period begins. Nothing in these Terms excludes, restricts or modifies consumer guarantees, cancellation rights, refunds or other remedies that cannot lawfully be excluded in your country or state.
If the Service is materially defective or a charge was unauthorised, contact us (section 22) so we can investigate and provide any remedy required by law.
Online games depend on networks, hosting providers, maintenance and evolving software. We do not promise uninterrupted or error-free operation. We may patch, rebalance, add, remove or change games and features, provided we do not unfairly deprive paying users of the material benefit of a current paid period.
We may temporarily suspend the Service for maintenance, security, legal compliance or events outside our reasonable control.
You may stop using the Service at any time and may request account deletion through Account Settings.
We may warn, restrict, suspend or terminate an account for a material or repeated breach of these Terms, fraud, non-payment, security risk, unlawful conduct or conduct that seriously harms the Service or other users. Where appropriate and lawful, we will provide notice or an opportunity to appeal.
Termination does not remove payment or recordkeeping obligations that already arose. Sections that by their nature should continue — including intellectual property, disclaimers, liability limits and dispute terms — survive termination.
When you complete the account-deletion process, we will disable login and delete or de-identify account data in accordance with the Privacy Policy, subject to legal retention requirements.
Past match and leaderboard records may remain in genuinely anonymised form so historical games remain coherent. An anonymised record must not identify you or be reasonably linkable back to your deleted account.
The Service and its original content, technology, visual identity and game systems are owned by or licensed to Command Arena and are protected by intellectual-property laws. Command Arena, its logos and game names may not be used in a way that suggests endorsement or affiliation without written permission.
These Terms do not prevent lawful commentary, reviews, screenshots, streaming or fan discussion. Commercial reuse of game assets, source code or substantial portions of the Service requires written permission.
You may send ideas or feedback voluntarily. You allow us to use that feedback without payment or restriction, but you retain ownership of any underlying material you already owned. Do not send confidential information unless we have agreed in writing to receive it confidentially.
The Service may use or link to third-party services, including payment, hosting, email and authentication providers. We are not responsible for an independent third party's service, content or privacy practices, but we remain responsible for our own obligations and for selecting and managing processors as required by law.
To the maximum extent permitted by law, the Service is provided on an "as available" basis. We do not guarantee that every game, opponent, ranking, network path or feature will always be available, secure or free from defects.
We do not exclude warranties, guarantees or duties that cannot legally be excluded. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
To the maximum extent permitted by law, Command Arena is not liable for indirect, incidental, special or consequential loss, loss of opportunity, loss of data or loss caused by events outside our reasonable control, except where such liability cannot lawfully be excluded.
Where liability may lawfully be limited, our total aggregate liability arising from the Service or these Terms will not exceed the greater of USD $100 or the amount you paid to Command Arena during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, deliberate wrongdoing, gross negligence where it cannot be limited, personal injury caused by negligence, or any other liability that applicable law does not permit us to exclude or limit.
You are responsible for losses reasonably caused by your deliberate unlawful misuse of the Service or material breach of these Terms. This section does not make you responsible for losses caused by us, impose an unfair consumer indemnity, or remove rights that cannot be waived.
These Terms are governed by New Zealand law, without regard to conflict-of-law rules. The courts of New Zealand have non-exclusive jurisdiction.
This choice of law does not deprive you of mandatory consumer protections or rights available in the country or US state where you ordinarily live. Before starting formal proceedings, please contact us (section 22) and allow a reasonable opportunity to resolve the issue.
We may update these Terms for legal, security, operational or product reasons. We will post the revised Terms with a new effective date. If a change materially affects existing users, we will provide reasonable advance notice and request renewed agreement where required.
A change will not retroactively authorise conduct or charges that were not allowed when they occurred.
